Terms of Service
1. Agreement
These Terms of Service ("Terms") govern use of the property management platform (the "Platform") operated by Tawil Technologies LLC ("Tawil Tech," "we," "us"). By creating an account, activating access provided by your property manager, or using the Platform, you agree to these Terms and to our Privacy Policy. If you use the Platform on behalf of a company, you represent that you are authorized to bind that company.
2. The service
The Platform provides property management and accounting tools, including lease management, rent billing, online payments, bank reconciliation, maintenance workflows, document signing, and reporting. Features available to you depend on your role (property manager, owner, or tenant) and on the subscription held by the property management company you are associated with.
3. Accounts
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Notify us promptly of any suspected unauthorized use of your account.
- We may suspend accounts that violate these Terms, present a security risk, or are subject to a legal requirement.
4. Payments and financial services
- Online payments are processed by Stripe. By making a payment you agree to Stripe's applicable terms. We do not receive or store full card numbers.
- Bank account connections are provided by Plaid. By linking a bank account you agree to the data practices described in our Privacy Policy and to Plaid's End User Privacy Policy.
- Tawil Tech is a software provider. We are not a bank, money transmitter, or escrow agent, and we do not provide legal, tax, or accounting advice. Amounts owed under a lease are determined by your lease and your property manager, not by us.
- Payment records displayed in the Platform reflect information from our payment and banking providers; in case of a discrepancy, the records of the financial institution govern.
5. Acceptable use
You agree not to: misuse or attempt to gain unauthorized access to the Platform or another user's data; probe, scan, or test the vulnerability of the Platform without written authorization; upload malicious code; use the Platform to violate any law, including fair-housing, debt-collection, and privacy laws; or resell or copy the Platform. We may investigate and involve law enforcement in response to violations.
6. Customer data
Property management companies retain ownership of the data they and their tenants and owners enter into the Platform. We process it as described in the Privacy Policy and, where applicable, a customer agreement. We may use aggregated, de-identified data to operate and improve the service.
7. Electronic signatures and records
The Platform supports electronic signing of leases and related documents. You consent to transact electronically and agree that electronic signatures and records have the same force as ink signatures and paper records to the fullest extent permitted by law.
8. Intellectual property
The Platform, including its software, design, and content (excluding customer data), is owned by Tawil Technologies LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Platform in accordance with these Terms.
9. Disclaimers
The Platform is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Tawil Technologies LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of or relating to the Platform will not exceed the greater of $100 or the amounts paid to us for the service in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Termination
You may stop using the Platform at any time; property management customers may terminate per their subscription agreement. Upon termination we handle data as described in the Privacy Policy. Sections 6, 8, 9, 10, and 12 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Kings County, New York, and the parties consent to their jurisdiction.
13. Changes
We may update these Terms from time to time. We will post changes on this page and update the effective date; material changes will be notified by email or in-app notice. Continued use after changes take effect constitutes acceptance.
